EEOC Issues New Enforcement Guidance

The Equal Employment Opportunity Commission has approved, by a 4-1 vote, a revised Enforcement Guidance on the Consideration of Arrest and Conviction Records in Employmentm Decisions under Title VII of the Civil Rights Act of 1964. The Guidance is effective immediately. Before disqualifying an individual with a criminal record from employment, the Commission emphasizes, employers should engage in an individualized assessment involving a dialogue with that individual. While the Guidance states that employers would not violate Title VII if they disqualify an applicant based on separate federal restrictions on the employment of personsn with criminal records, an employer may not defend a decision to disqualify an individual solely on state restrictions on the hiring of persons with criminal records.

Emerging Regulations -DOT

The Substance Abuse and Mental Health Services Administration (SAMHSA) recently announced that it accepted the recommendations of its Drug Testing Advisory Board (DTAB), and will proceed with drafting revisions to the DHHS Mandatory Guidelines for Federal Workplace Drug Testing Programs. The changes would include:

1. Expanding the drug testing panel to include additional Schedule II prescription medications (e.g., oxycodone,              oxymorphone, hydrocodone and hydromorphone).
2. Including oral fluid as an alternative specimen for Federal Drug Free Workplace testing.

The Department of Transportation’s (DOT) Office of Drug and Alcohol Policy and Compliance (ODAPC) stated, “The opportunity to address the illicit use and abuse of these additional Schedule II drugs in the transportation industries is an important way to limit their misuse in our communities and a great way to serve transportation safety, while getting those who need treatment into treatment. And please know that oral fluid testing will be a bonus to our regulated transportation industry program; and will certainly serve to assist the DOT’s National Highway Traffic Safety Administration in its efforts, with others, to establish national per se laws for Driving under the Influence of Drugs (DUID).”

Government Holidays  - Court Delays Expected 
Delay in results expected on Tuesday, 11/08/2011 and Friday, 11/11/2011 in observance of Election Day and Veterans Day.  Multiple courts will be closed both days both at the State and County level. Please expect delays.

State of Minnesota Delays Expected
Please be advised that the State of Minnesota will shut down effective July 1, 2011 due to unresolved budget matters.  At this time, court slow downs are expected.

Georgia Illegal Immigration Reform and Enforcement Act
Georgia enacted the Illegal Immigration Reform and Enforcement Act of 2011. Signed into law on 05/13/2011 the Act requires private employers, before issuance or renewal of a business license or an occupational tax certificate, to register and use the federal governments E-Verify program to verify the employment eligibility of employees.

The bill takes effect in three stages:
-Effective 01/01/12 for employers with 500 or more employees
-Effective 07/01/12 for employers with 100 or more employees but fewer than 500
-Effective 07/01/13 for employers with more than 10 employees but fewer than 100

Philadelphia, PA Legislative Changes 
Effective July 13th, 2011 public and private employers with at least 10 employees operating in the city of Philadelphia, PA may not ask candidates to disclose any arrest that did not result in a conviction and may not ask about any criminal convictions during the application process or during an initial interview.
